some organisations may have employees who pay Class A1 PRSI only while others may have a mix of Class A1 and Class D1 PRSI employees.

some organisations may have employees who were designated for transfer from other organisations and whose pension conditions may not be worsened on transfer.

PAPS ensures that scheme rules are drafted or amended to ensure the scheme reflects the requirements of the organisation in question.

As well as being a legal requirement under pension scheme disclosure legislation, it is also highly desirable that the scheme rules are explained as simply as possible to the members. One of the ways in which this can be done is through an information booklet on the scheme. PAPS can assist organisations in meeting their legal obligations and in tailoring the scheme booklet to meet their needs and preferences.

Training for Administrators

It is important that scheme administrators understand the rules of the scheme and how they should be applied in determining members’ benefits. PAPS has developed a number of training modules for administrators designed to give either –

a practical insight into and general understanding of the scheme rules generally and how they work or

a detailed examination of the scheme rules related to either particular member categories or specific types of benefits.

Information for Scheme Members

Under pension scheme disclosure legislation, pension scheme administrators are obliged to give scheme members certain types of information such as –

information on the scheme rules, i.e. the scheme booklet

an annual report on the scheme

an annual benefit statement.

It is also desirable that organisations provide regular information sessions on the pension scheme and any developments introduced or proposed for its employees.

Through its experience and expertise in this area, PAPS can ensure that organisations keep their scheme members fully informed about their rights and entitlements.

Advice in Relation to Individual Cases

Public sector pension scheme rules can be quite complex. It is essential, therefore, that these rules be applied properly so as to ensure that members’ benefits are calculated correctly.

While many cases are straightforward, there is a growing trend towards unusual cases, mainly due to the extension of scheme membership to part-time and contract employees and the increased tendency by employees to take career breaks and avail of family friendly schemes.

PAPS advises organisations on how to deal with individual cases and queries. This facility is of particular benefit to those organisations –

who are not required to deal with pension cases on a regular basis and/or

who may have lost the services of an experienced pensions administrator.

Support in Relation to Pension IR Issues

From time to time, issues may arise on the pensions front with IR implications. This may involve a requirement for organisations to prepare submissions for presentation to the Labour Court or Labour Relations Commission and attend relevant meetings.

Outside of the IR area, organisations may also be required in certain dispute cases to prepare material for submission to the Pensions Ombudsman.

PAPS is in a position to assist organisations in this area.
